AwayGame Terms of Service

AwayGame is a digital platform that connects sports fans with restaurants, bars, lounges, and other establishments ("Venues") that choose to identify themselves as welcoming supporters of particular sports teams or sporting events.

AwayGame does not own, operate, manage, or control any Venue listed on the Platform. AwayGame serves solely as an informational and promotional platform that enables users to discover participating Venues.

You must be at least eighteen (18) years old to create an account or use certain features of the Platform.

Some Venues may serve alcoholic beverages or impose age restrictions. Users are solely responsible for complying with all applicable laws and Venue policies before attending any establishment.

By using the Platform, you represent that:

• You are legally permitted to use the Platform.
• All information you provide is accurate and current.
• You will comply with these Terms and all applicable laws.

Users may create accounts to access certain Platform features.

You agree to:

• Provide accurate and complete information.
• Maintain the security of your account credentials.
• Promptly update any information that changes.
• Accept responsibility for all activities occurring under your account.

AwayGame reserves the right to suspend or terminate accounts that violate these Terms or are suspected of fraudulent, unlawful, or abusive conduct.

Venue owners or their authorized representatives may claim, create, or manage Venue listings.

By submitting information to AwayGame, Venue representatives represent and warrant that:

• They are authorized to manage the Venue's listing.
• All submitted information is accurate and complete.
• The Venue has permission to display sporting events consistent with applicable licensing requirements.
• The Venue will make commercially reasonable efforts to accurately represent the teams and sporting events it promotes on the Platform.

AwayGame does not guarantee that any listed Venue will:

• Show a particular game or sporting event.
• Display games at any particular time.
• Admit all patrons.
• Maintain posted hours of operation.
• Continue supporting any listed team or fan community.

Venue information may change at any time without notice.

AwayGame makes no guarantees regarding:

• Game availability.
• Seating availability.
• Admission policies.
• Food or beverage offerings.
• Cover charges.
• Parking availability.
• Venue capacity.
• Service quality.
• Team-specific promotions.

Users are encouraged to contact Venues directly before attending if they have questions regarding availability or accommodations.

You agree not to:

• Violate any applicable law.
• Harass or threaten other users or Venue personnel.
• Submit false or misleading information.
• Impersonate another person or business.
• Attempt to interfere with the Platform's operation.
• Use the Platform for unlawful, fraudulent, or abusive purposes.
• Upload malicious software or otherwise compromise Platform security.

AwayGame reserves the right to remove content or suspend accounts at its sole discretion.

AwayGame allows Venues to voluntarily identify sports teams or fan communities they welcome.

AwayGame is not affiliated with, endorsed by, sponsored by, or authorized by any professional, collegiate, or amateur sports league, team, organization, or athlete unless expressly stated otherwise.

All trademarks, logos, and team names remain the property of their respective owners.

The inclusion of any team name or fan community on the Platform does not constitute an official affiliation with AwayGame.

AwayGame may offer premium subscriptions, advertising services, featured listings, or other paid services.

All fees will be disclosed before purchase.

Unless otherwise stated:

• Payments are non-refundable.
• Subscription services automatically renew until canceled.
• AwayGame reserves the right to modify pricing upon reasonable notice.

Additional terms may apply to paid products or services.

The Platform may integrate or link to third-party services, including but not limited to:

• Google Maps
• Payment processors
• Messaging services
• Analytics providers
• Social media platforms

AwayGame is not responsible for the content, policies, or practices of any third-party services.

Your use of such services may be governed by their respective terms and privacy policies.

You retain ownership of content you submit to the Platform, including:

• Reviews
• Photos
• Profile information
• Venue descriptions
• Messages
• Promotional materials

By submitting content, you grant AwayGame a worldwide, non-exclusive, royalty-free license to use, display, reproduce, modify, distribute, and promote such content solely in connection with operating and marketing the Platform.

You represent that:

• You own or possess all necessary rights to the submitted content.
• Your content does not infringe upon the rights of any third party.
• Your content is lawful and accurate.

AwayGame may remove content at any time in its sole discretion.

Each Venue is independently responsible for:

• Compliance with all applicable laws.
• Appropriate alcohol service practices.
• Sporting event licensing requirements.
• Food safety standards.
• Employment practices.
• Admission policies.
• Customer service practices.

AwayGame assumes no responsibility for the actions or omissions of any Venue.

Users voluntarily assume all risks associated with visiting any Venue, including but not limited to:

• Personal injury
• Property damage
• Alcohol consumption
• Crowd-related incidents
• Sporting event cancellations
• Service interruptions
• Transportation issues

AwayGame is not responsible for any injuries, damages, disputes, losses, or incidents arising from attendance at any Venue.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AWAYGAME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO:

• YOUR USE OF THE PLATFORM;
• ANY VENUE LISTING;
• SPORTING EVENT AVAILABILITY;
• USER OR VENUE CONDUCT;
• SERVICE INTERRUPTIONS;
• LOST PROFITS OR LOST BUSINESS OPPORTUNITIES; OR
• ANY THIRD-PARTY SERVICES.

You agree to defend, indemnify, and hold harmless AwayGame and its officers, employees, affiliates, contractors, and agents from any claims, damages, liabilities, costs, and expenses arising from:

• Your use of the Platform;
• Your violation of these Terms;
• Your submitted content;
• Your violation of applicable law; or
• Your interactions with other users or Venues.

All Platform content, including:

• Software
• Design elements
• Branding
• Graphics
• Text
• Logos
• Features and functionality

are owned by AwayGame or its licensors and are protected under applicable intellectual property laws.

No portion of the Platform may be copied, reproduced, or distributed without prior written permission.

AwayGame may suspend or terminate access to the Platform at any time if:

• These Terms are violated;
• Fraudulent activity is suspected;
• Required by law; or
• Necessary to protect the Platform or its users.

Termination does not affect provisions intended to survive termination, including indemnification, limitation of liability, and intellectual property protections.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."

AWAYGAME DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF:

• MERCHANTABILITY;
• FITNESS FOR A PARTICULAR PURPOSE;
• NON-INFRINGEMENT;
• ACCURACY OF INFORMATION;
• UNINTERRUPTED SERVICE; AND
• ERROR-FREE OPERATION.

AWAYGAME DOES NOT WARRANT THAT THE PLATFORM WILL ALWAYS BE AVAILABLE OR THAT VENUE INFORMATION WILL ALWAYS BE CURRENT OR ACCURATE.

We may modify these Terms at any time.

Updated versions will be posted on the Platform together with the revised Effective Date. Continued use of the Platform constitutes acceptance of any revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, unless otherwise required by applicable law.
